REWIND: International Business News #31

REWIND: International Business News #31
  • Google and the European Union are nearing a settlement deal on an antitrust investigation into the search giant?s dominance in the internet market in areas of search, travel, and other industries. The E.U. said that Google may have abused such dominance in search and advertising by promoting its own businesses at the expense of its competitors. The settlement may require changes to the company?s business practices that could have an effect on users worldwide. The Federal Trade Commission and regulators in other nations are following the case closely.
  • There is no end in sight for the world?s largest environmental litigation debacle as dissent erupts among the plaintiffs who won an $18.2 billion verdict against Chevron in an Ecuadorian court.? After an 18-year legal battle, the plaintiffs, farmers and indigenous Amazonian Indians, won the biggest single pollution judgment ever for harm caused by oil exploration and production in eastern Ecuador. Chevron, however, has stated that it will not pay the judgment as the verdict was part of a fraudulent conspiracy involving attorneys, judges, and government officials in both the United States and Ecuador. ?Chevron maintains that any pollution remaining in the rainforest was caused by Petroecuador, Ecuador?s national oil company. In addition, one group of Amazonian Indians in the class of plaintiffs currently represented by New York practitioner, Steven Donziger, are filing a suit against Donziger, alleging that Donziger is not representing their group?s interests and requesting that he explain how his team plans to spend the billions of dollars from the judgment.
  • From the patent dispute between Apple Inc. and Korean manufacturer, Samsung Electronics Co., to automotive litigations involving Japanese and Korean corporations, to the increasing number of deals and disputes in emerging economies like Brazil and India, law firms are finding a need for attorneys with language skills and are hiring them in droves.? The attorneys are often brought on as temporary hires and offer the firms more bang for the buck with both legal and linguistic skills.? The mass hires typically happen when the firms are under deadline to review a large number of documents in a short timeframe.
  • ?There will be many commercial interests looking to gain at this summer?s London Summer Olympics.? Indeed, the endeavor involves significant sums, including a budget of $14.5 billion from the British government, $4.87 billion in broadcast fees and sponsorship raised by the IOC for the summer Olympics and the 2010 Vancouver Winter Olympics and another 700 million pounds raised by the London Organising Committee of the Olympic and Paralympic Games.? The IOC has also entered large corporate sponsorship contracts with eleven global sponsors, including Coca-Cola, Procter & Gamble, McDonald?s, and Panasonic, which for the period of 2009-12 has generated $957 million. Sponsors may pay in cash or kind, so some, like French consultant firm, Atos, are providing information technology services for the games. Although such companies believe that the Olympic sponsorship will have a positive effect, some are more cautious and believe that the Olympic boost will be less than expected.

Bill Clinton endorses Tarryl Clark in Minnesota?s 8th District

Former President Bill Clinton took sides Friday in the contentious Democratic primary for Minnesota's 8th District, voicing support for former state Sen. Tarryl Clark.

"From her work with the Children's Defense Fund and Legal Services' Senior Law Project, to her commitment to coalition building while leading the state's Community Action Partnership, Tarryl's focus for almost 25 years has been improving Minnesota," Clinton said in his announcement Friday. "I am confident she will bring the common-sense solutions we need to Washington."

Clark is competing against former Rep. Rick Nolan and Duluth City Councilor Jeff Anderson in the Aug. 14 Democratic primary to take on Republican Rep. Chip Cravaack this fall. Both parties mark this general election race as one of the most hotly contested in the country.

Clinton has been wading into competitive primaries this cycle, offering support to loyalists including Rep. Mark Critz in Pennsylvania's 12th District, Rep. Brad Sherman in California's 30th and Rep. Bill Pascrell in New Jersey's 9th District. All three faced or will face a fellow House colleague in their primary contest.

Vulnerability Management for a Cyber Secure Corporate World ...

Internet and Technology | Computers and Technology | * Written by Patrica | Friday, 27 July 2012 02:23 | Word Count: 535

Today's global organization with its technology landscape of networked servers, desktops and other hardware equipment and innumerable software applications is vulnerable to information thefts and cyber- attacks. Though technology enhancements facilitates easy access to critical data across distant locations, the unseen loopholes and deficiencies make data and networks prone to cyber-attacks both from within and outside. Organizations need to have adequate security measures in place to combat these sophisticated threats.

Organizations in their attempt to protect their critical information, either work out in-house solutions to manage the vulnerabilities, or outsource help from experts. Whatever be the mode, the vulnerability management programs ensure proper risk tolerance levels, create operational processes, and select the right technology platforms to prop up the processes. Vulnerability Management is a measurable and continuous process that facilitates organizations to understand the existing risks in its IT environment and paves way to protect the organizational data, customer information, network assets and intellectual property.

With data stored in digital form being the core of Governance, Risk, and Compliance Management process for any enterprise, the assets on which these reside and the data itself both needs to be managed efficiently. Further, the dependency of the global organizations on information technology to collaborate and share data and information through web applications and social-networking sites has only increased the vulnerability status of the organizations and the demands on the IT departments. However, proactive addressing of the vulnerability issues will help to significantly reduce the misuse of such facilities.

Leading service providers offer an integrated compliance management solution to organizations that look for solutions to manage the security levels. These solutions conduct an automated scan of the network infrastructure and its related vulnerabilities and works as an effective risk management solutions.

The enormity of the security threats calls for an effective vulnerability management solution. The solutions provided by the leading service providers ensure:

1. Accuracy in asset discovery through network discovery, mapping and asset prioritization

2. Provision of single and centralized repository for all assets and vulnerabilities

3. Ability to link the Assets to security controls

4. Facilitates exhaustive audits for all compliance related actions.

5. Remotely scans various sources for vulnerabilities

The vulnerability management solutions besides mapping the assets ( documents, work-flow, repositories) and vulnerabilities to regulations through a secure web based interface, also prioritizes, designs solutions and tracks remediation of complex IT risks and vulnerabilities. Such integrated solution for managing the functions, data and tasks associated with assets helps organizations to manage the security operations in-house.

Apple Considered Investing Hundreds of Millions in Twitter

This entry needs translation. To help us and submit a translation please click here

Apple considered a large investment in Twitter reports the New York Times and Wall Street Journal.

The NYT says Apple was in talks with Twitter 'in recent months' about a strategic investment.

Apple has considered an investment in the hundreds of millions of dollars, one that could value Twitter at more than $10 billion, up from an $8.4 billion valuation last year, these people said. They declined to be named because the discussions were private.

There is no guarantee that the two companies, which are not in negotiations at the moment, will come to an agreement. But the earlier talks are a sign that they may form a stronger partnership amid intensifying competition from the likes of Google and Facebook.

The WSJ has a slightly different report saying that Apple held discussions with Twitter more than a year ago.

Apple Inc. held discussions with Twitter Inc. more than a year ago about taking a strategic investment in the short-messaging service, according to a person familiar with the talks. People familiar with the matter said there are no current formal investment or acquisition discussions between the companies.

You can download Twitter from the App Store for free.

Reality TV romances beyond 'The Bachelorette'

Craig Sjodin / ABC

Emily Maynard on "The Bachelorette."

By Ree Hines

Another season of ?The Bachelorette? is over, and once again, true love -- or a reasonable facsimile -- prevailed. Yes, after weeks of cycling through suitors, (spoiler alert!) Emily Maynard gave her final rose to Jef Holm and he gave her a proposal (and a great big diamond too). And of course, she said yes.

Now they?ll live happily ever.... OK, who are we kidding? If Emily and Jef go the way the vast majority of couples from the ?Bachelor? and ?Bachelorette? reality TV franchise have, they?re far more likely to say ?I don?t? than ?I do? to each other.

In fact, with 24 seasons and 24 potential pairings between the two shows, only two season-ending couples ever swapped vows.

Trista Rehn and Ryan Sutter, from the first season of ?The Bachelorette,? were married on an ABC special (aptly titled ?Trista and Ryan?s Wedding?) in 2003. Today they?re still together and have two children.

And while Jason Mesnick gave his final rose to Melissa Rycroft on ?The Bachelor?s? 13th season finale, he married his last-minute switcheroo pick, Molly Malaney. They too were married on an ABC special (aptly titled ?Jason and Molly?s Wedding?) in 2010.

Two other couples can kind-of-sort-of chalk up their marriages to the shows, but they didn?t actually share any on-screen time together. Jesse Csincsak, of ?The Bachelorette?s? fourth season and Ann Leuders of season 13 of ?The Bachelor? walked down the aisle after meeting as show alums. It was much the same story ?Bachelor 10?s? Petyon Wright and her now-husband ?Bachelorette 6?s? Chris Lambton.

But that?s it!

Now don?t let those results lead you to lose faith in finding real love on the boob tube. Just because the shows that aim for a happily-ever-after often fail to find it, that doesn?t mean reality TV is lacking in love. You just have to know where to look.

?Survivor?

Somewhere in between their attempts to outwit, outplay and outlast their tribemates, a few ?Survivor? castaways managed to out-romance the competition and walk away from the game with the ultimate reality TV alliance -- marriage.

The first and probably best known ?Survivor? union is the one between ?Boston Rob? Mariano and Amber Brkich, two past players who found love during the ?All-Stars? season, got engaged on finale night and made it official months later. They?re now the proud parents of three children.

Jaime Dugan and Erik Huffman met during ?Survivor: China? and tied the knot less than two years later. Alex Bell and Kim Powers, of the ?Amazon? and ?Africa? editions of the show respectively, also found love on ?Survivor.?

And the Jeff Probst-hosted reality TV staple could soon claim two more marriages. Past players and longtime couple Jenna Morasca (?Survivor: Amazon? and ?All-Stars?) and Ethan Zohn (?Survivor: Africa? and ?All-Stars?) are currently engaged, as are ?Redemption Island? pair David Murphy and Carolina Eastwood.

?Biggest Loser?

There?s something about this weight-loss competition that leads to gaining spouses. Whether it?s the shared goals, the hard work or just the close quarters on the ?Biggest Loser? ranch, the experience produces lasting love results.

For instance, while there were no visible sparks between season-two winner Matt Hoover and third-place ?Loser? Suzy Preston during the show's run, the two fell for each other all the same. Months after their season ended, the pair appeared on TODAY, and Matt popped the question. Suzy accepted. The couple married in 2006 and have two children together.

During the finale for season three of ?The Biggest Loser,? Marty Wolff became engaged to his former co-competitor Amy Hildreth. They later married and now have a child. And Stephanie Anderson and Sam Poueu, who met and fell in love in ?Loser?s? ninth season, married in April of this year.

The next ?Biggest Loser? success story to take place off the scale could be the match between former contestants Antoine Dove and Alexandra White, who were engaged during the season eight finale.

Marriages aside, both ?Biggest Loser? and ?Survivor? are responsible for plenty of other relationships, and the two reality competitions are far from the only ones to be able to boast that. In fact, for ?American Idol? it?s practically a regular occurrence, with Jessica Sanchez and fellow ?Idol? alum De Andre Brackensick being the show?s latest love connection. Engaged couple Brendan Villegas and Rachel Reilly met on ?Big Brother,? which is known for its frequent ?showmances.? Even ?Dancing With the Stars? can claim pro-and-partner matches, as well as pro-and-pro ones, over the course of the show?s seasons. But romances rarely seem to last in the ballroom bash.

Are you surprised by the unlikely places couples find love on reality TV? Share your thoughts about the romance-themed shows vs. the shows that actually lead to more romances on our Facebook page.

Insurance News - Elderly Medicare Beneficiaries Most Satisifed With ...

New Study: Elderly Medicare Beneficiaries Most Satisifed with Their Health Insurance; Working-Age Adult with Private Coverage Report More Trouble Accessing Care, Paying Medical Bills

NEW YORK, July 18 -- The Commonwealth Fund issued the following news release:

Elderly beneficiaries enrolled in Medicare plans are more satisfied with their health insurance, have better access to care, and are less likely to have problems paying medical bills than people who get insurance through employers or those who purchase coverage on their own, according to a new Commonwealth Fund study (http://www.commonwealthfund.org/Publications/In-the-Literature/2012/Jul/Medicare-Beneficiaries-Less-Likely-to-Experience-Cost.aspx) published today in Health Affairs. The study also found that beneficiaries enrolled in private Medicare Advantage plans are less satisfied with their insurance than those with a traditional Medicare plan, and more likely to experience access problems.

The study, "Medicare Beneficiaries Less Likely To Experience Cost- And Access-Related Problems Than Adults With Private Coverage," by Commonwealth Fund researchers Karen Davis, Kristof Stremikis, Michelle Doty, and Mark Zezza, finds that only 8 percent of Medicare beneficiaries rated their insurance as fair or poor, compared with 20 percent of adults with employer insurance and 33 percent who purchased insurance on their own. As the federal government weighs proposals to cut Medicare spending, the analysis, based on results from The Commonwealth Fund Biennial Health Insurance Survey of 2010, suggests shifting Medicare beneficiaries into private plans could put the elderly at greater risk for not getting needed health care and being less satisfied with their insurance.

The study finds that Medicare beneficiaries have better access to care and greater financial protection than adults with private coverage. In 2010 about one-fourth (23%) of Medicare beneficiaries went without needed health care because of costs, compared with 37 percent of those with employer coverage. Adults with employer-based insurance (39%) and individual insurance (39%) reported medical bill problems at almost double the rate of Medicare beneficiaries (21%). The study finds that while health care access and medical bill problems worsened for adults with all types of coverage over the past decade, Medicare continued to provide better coverage during that time period.

"Medicare continues to do better than employer-sponsored and individual plans when it comes to providing people with good access to health care and adequate protection from burdensome medical bills," said Stremikis, senior researcher at The Commonwealth Fund. "Policies designed to move the elderly out of Medicare and into private plans need to be carefully designed, so as not to expose beneficiaries to the poorer access to care currently experienced by many working-age adults with private insurance."

Exclusive agent marketing program launches with Betty White

The study found that those with individual and employer-based coverage were far more likely than Medicare beneficiaries to incur high out-of-pocket costs. Twenty-nine percent of elderly adults with Medicare reported spending 10 percent or more of their income on medical costs, compared to 37 percent of adults with employer-based insurance and 58 percent with individual insurance. Only 13 percent of Medicare beneficiaries were unable to pay for basic necessities such as food or rent or used up all their savings to cover medical bills, compared to 27 percent of adults with employer-based insurance and 33 percent with individual insurance.

Medicare Advantage vs. Traditional Medicare Within Medicare, satisfaction rates differed depending on whether beneficiaries were enrolled in traditional Medicare plans or in Medicare Advantage plans offered by private insurance companies. Fifteen percent of elderly people with Medicare Advantage rated their insurance as fair or poor, compared with just six percent of those with traditional Medicare coverage.

The study also found that although Medicare Advantage enrollees were less likely to spend 10 percent or more of their income on premiums and out-of-pocket costs, they were more likely to report cost-related access problems than elderly adults with traditional Medicare. Thirty-two percent of beneficiaries with Medicare Advantage reported at least one access problem due to cost, compared with 23 percent of those with traditional coverage. The authors say this may in part reflect Medicare Advantage beneficiaries' experience with private HMO plans that offer lower premiums in return for limited access to a smaller network of providers.

Looking Ahead The authors conclude that "in the policy debates over the federal budget deficit, the affordability of Medicare, and the expansion of health insurance through the Affordable Care Act, listening to the experiences of individuals, whether covered by Medicare or private employer insurance, is important." Given the more positive experiences of those covered by Medicare, states may want to consider offering traditional Medicare coverage to non-elderly individuals through the state exchanges to be set up in 2014.

"As we expand insurance and move toward near-universal coverage, it is imperative that we ensure health plans provide financial protection and good access to care," said Commonwealth Fund President Karen Davis. "The achievements of Medicare in fulfilling the goals of health insurance coverage for beneficiaries can provide important lessons for the entire U.S. health system."

Methodology

The study data came from the Commonwealth Fund 2010 Health Insurance Survey, a nationally representative telephone survey of 4,005 adults, age nineteen or older, living in the continental United States. The survey was conducted by Princeton Survey Research Associates International from July 14 to November 30, 2010 using an overlapping dual-frame survey of land-line phones and cell phones. The survey oversampled adults from telephone exchanges in geographic areas with a high density of low-income households. The final sample consisted of 2,550 interviews conducted by landline phone and 1,455 interviews conducted by cell phone, including 637 in households with no land-line phone. The survey was a twenty-five- minute telephone interview administered in English or Spanish. In this study we restricted the analysis to a sample of 3,033 adults ages 19-64 and 940 adults age 65 and older.

Real Estate Buying Tips To Get The Most For Your Money | Buy ...

The purchase of a piece of real estate can be a large step in anyone?s life, but it is especially so for someone who is a first time buyer. The costs and the thought of such a long-term, expensive committment can exert a lot of stress on many people. Let the following proven real estate tips take the stress out of your own investments.

Prior to purchasing any real estate, you first need to have a firm understanding of what a mortgage loan is and its many terms and conditions. The important things you need to know are how the loan term affects your monthly payment and the amount of interest you will have to pay throughout the loan period.

If you want to start a business, do some research about the neighborhood and select the best location possible. If you open your business in a down trodden community, a large base of clientele is unlikely to happen. Consult your real estate agent to find the best place to open your shop.

If you want a great investment in buying property, you should think about repairing and remodeling it. This increases the value of your investment by boosting its resale value. Sometimes your property value will increase more than the money you put in.

If you don?t live a cold climate, avoid buying a house with a fireplace. It is a real hassle to keep up with cleaning multiple fireplaces and they are rarely used anyway.

Save up enough of a down payment to satisfy your lender. If you do not, you may be stuck paying more through PMI, or Private Mortgage Insurance. This can cost a lot more than you?d need to pay than if you went for a conventional mortgage.

Any property near a busy road or freeway will earn less rent. These homes tend to be less expensive than those in the middle for a reason. Even if you are okay with the constant noise, many other people won?t be, which means it will sit on the market when you try to sell.

If you have a home that you are serious about purchasing, make sure that you measure the square footage properly. Make sure your home?s square feet is listed correctly on the public record. The difference between these two figures should be no more than 100 square feet; if it is more than that, either rethink your purchase, or find out the reason.

Collect data about your local housing market. Give City-data.com a visit or any other sites like it so you can learn about the average housing prices, number of foreclosures and other relevant market conditions within a 15 mile radius. Also, you should check out local employers, the unemployment rate, and average income level. A product with a great location can actually override local trends.

Closely track pre-foreclosure properties. If you have a significant amount of time to invest in finding an investment property, pre-foreclosure properties might be something to consider. When an owner is at high risk of having their home taken back by the bank thanks to delinquent payments is a situation known as pre-foreclosure property. You can advertise your own willingness to purchases houses with cash, or consult lenders to get lists of properties approaching pre-foreclosure. Find the person who is presently paying the loan and bid several thousand above their payoff, if it fits the market value. Few people owe the entire market value of their house, which makes this an attractive prospect.

If you are serious about purchasing a property, get a professional building inspector to have a look at it. It will require a fair amount of money, but the advantage over having someone you know inspect the home is that you can hold a bad inspection against a professional inspector, while there is little you can do to a relative.

Talk to your prospective landlord about who is responsible for maintaining the landscape before you sign the lease agreement. Sometimes rentals require that you handle it yourself, or for you to hire a gardener or yard person. It?s also important to find out which utilities costs you will be responsible for.

When selecting an agent to help you with your home search, ask them how long they have lived in the area. If they have only been around for a short while, they are not going to know as much about the roads, community restrictions and neighborhoods as someone else. An agent residing in the area 10 years or more is preferable.

When considering the purchase of a new home, it?s very important that you look at the long-term and not just the short-term. While you might not have children currently, you should look at the quality of area schools if you think you may still reside there when you do have children.

You must research the neighborhood of a home before you buy. You need to find the neighborhood that fits your living needs just right or you will be very disappointed in the future. You need to know the neighborhood you are moving in so you know what you are getting yourself into.

Ready to buy now? Hopefully, the tips above have helped ease your concerns. Just try some of the suggestions. Not every suggestion will work for you, of course, but the ones that match your interests and circumstances should make it far easier for you to purchase your first property. Buying real estate can be simple. Think about how it feels to have a piece of property you can call your own. Keep track of your budget and make the best decisions you can.

ShoreTel Expands Video, IM Capabilities in UC Platform | Kingisepp

ShoreTel is expanding the video conferencing
and instant messaging capabilities of its unified communications platform,
leveraging open standards to help businesses increase employee productivity.

The company?s ShoreTel 13 software release,
announced July 17, takes advantage of new capabilities within ShoreTel
Communicator, the platform?s call manager application, to broaden the video
collaboration and IM features.

The updated ShoreTel Communicator enables
users to participate in room-based video conferences using desktops or laptops
that support the H.264 industry standard. ShoreTel already has begun
integrating its offering with systems from LifeSize Communications, Logitech?s
video communications business, and Polycom, and is working to become certified
with other vendors, according to Jeff Ridley, ShoreTel?s director of product
management.

The use of the H.264 protocol is part of
ShoreTel?s larger embrace of open standards, including Extensible Messaging and
Presence Protocol (XMPP) and Session Initiation Protocol (SIP), to make unified
communications (UC) more ubiquitous, Ridley told eWEEK.

?With this release [of ShoreTel 13], we are
emphasizing the openness of the platform,? he said.

Video collaboration is increasingly important
as enterprises look for ways to improve employee productivity, improve
communications and reduce corporate costs, such as travel expenses. Users now
are looking to be able to leverage the systems they have to communicate with
others, regardless of whose technology is being used, Ridley said.

By having ShoreTel 13 support the H.264
standard, users can participate in room-based video conferences through their
desktop PCs or notebooks. Users, through their PCs, can dial into the
room-based system and they become part of the video conference.

?What the world didn?t need is another video
standard,? Kevin Gavin, ShoreTel?s chief marketing officer, told eWEEK.

It made more sense to leverage H.264 and SIP
to give users the capability to easily connect into video conferences from
their PCs, Gavin said. ShoreTel leverages multiple open interfaces that enable
easy integration of third-party applications from video collaboration vendors.

The simplicity of the solution is a key
differentiator for ShoreTel, he said. Other vendors, like Cisco Systems, may
also offer similar capabilities, but they tend to be more complex and difficult
to use.

ShoreTel also is expanding the instant
messaging capability to all users by enabling IM in ShoreTel Communicator for
Personal Access at no extra cost. Before, the IM capability had only been
available in the company?s Professional version, Ridley said. Businesses
through ShoreTel Communicator also can use standards-based IM servers, including
ShoreTel?s own XMPP IM server or Microsoft?s Lynch, Gavin said.

Instant messaging is becoming a key
form of communication for employees, making it important to increase access to
it, Ridley said.

?We see it as basic as the phone to
communications,? he said.

ShoreTel 13 also includes enhancements to SIP
interfaces, extending enterprise contact center agent capabilities enabled from
SIP trunking service providers.

House weighs military sports sponsorships

WASHINGTON (AP) -- Congress is wrapped around the axle over the military spending millions of dollars to sponsor NASCAR cars and other sports in a bid to boost recruiting.

Republican Rep. Jack Kingston of Georgia and Democratic Rep. Betty McCollum of Minnesota are pushing an amendment to cut $72.3 million from a $608 billion defense spending bill for military sponsorships. The House began debating the bill Wednesday. The two argue that in a time of growing deficits the money could be better spent elsewhere.

The measure would target money the National Guard uses to sponsor Dale Earnhardt Jr. in NASCAR, the Marine Corps spends on Ultimate Fighting Championship and other sponsorships ranging from fishing to hot rod racing.

Yet the two lawmakers are facing resistance from their colleagues and sports leagues.

Officials track down assets of disgraced Iowa CEO

(AP) ? Investigators are moving quickly to seize the wide-ranging personal assets of the disgraced founder of an Iowa brokerage so they can try to reimburse thousands of customers and workers affected by his alleged $200 million fraud.

Former workers at Peregrine Financial Group Inc. and other companies controlled by Russ Wasendorf Sr. said they were stunned by the dramatic downfall of the prominent businessman and were trying to rebuild their lives after losing their jobs. About 75 of the estimated 250 Iowa workers affected attended a meeting Wednesday at a community college in Waterloo, where they learned about unemployment, job training and other benefits.

Wasendorf's business empire collapsed last week after he was found unresponsive in his car outside Peregrine's headquarters in Cedar Falls following a suicide attempt. He left a note in which investigators say he detailed how he embezzled customer funds for nearly 20 years and falsified bank records to fool regulators. Federal regulators shut down his firm, which was missing more than $200 million in customer accounts that it claimed to have, and it filed for bankruptcy.

Underscoring the diverse assets that investigators are trying to untangle, Wednesday's meeting drew workers from the brokerage, an upscale Italian restaurant that Wasendorf opened in Cedar Falls, the company's charitable arm, and Wasendorf's publishing company.

"It was shocking abruptness. You just don't see something like that coming," said Nick Kollasch, 25, who moved to Cedar Falls four months ago to take a job as a cook at myVerona, the restaurant. He said he's proud the restaurant raised the bar for fine dining in Cedar Falls, a town of 40,000 people, but he knows he will have difficulty earning the same salary elsewhere.

Wasendorf was arrested Friday at an Iowa hospital and charged with lying to regulators. Federal prosecutors say they will seek additional charges that could land Wasendorf, 64, in prison for the rest of his life. He hasn't yet entered a plea.

In portions of his note that have not been made public by the FBI, Wasendorf said he spent most of the missing money to prop up PFG and to pay its business losses and fines and fees charged by regulators, according to the Wall Street Journal, which received the statement from a "person familiar with the situation." Wasendorf wrote that a portion went to build its $24 million, state-of-the-art headquarters in Cedar Falls, the paper reported. Attempts by The Associated Press to obtain the same material were not successful.

A court filing in Peregrine's bankruptcy case shows roughly 24,000 customers had accounts with the firm and are missing money. An industry regulator told customers it's not clear when they will have access to their funds.

Officials appointed to manage the assets of the firm and those of Wasendorf say they have made progress identifying valuable real estate properties and a range of other companies that he controlled. They say Wasendorf owned two Chicago condominiums that property records show are worth a combined $1.3 million, plus the restaurant, the publishing company, a construction company and an aircraft firm that owned at least one jet.

The assets identified so far stretch from Iowa to Florida to Europe, according to a court filing. The receiver says it has been given expanded authority to take control of funds from companies controlled by Wasendorf and take all "necessary and appropriate" actions to seize his other assets.

"We are looking diligently to find assets that he owned or had control of," said Randall Lending, a lawyer for receiver Michael Eidelman. "We're working closely with the (bankruptcy) trustee to hopefully make substantial recoveries for people that lost money."

The U.S. Commodity Futures Trading Commission has asked a judge to prohibit Wasendorf from "withdrawing, transferring, removing, dissipating, concealing or disposing of" any funds, personal property or securities that he controls.

Facing a freeze on his assets, Wasendorf learned he could not afford to hire Chicago lawyer Thomas Breen to represent him in the criminal case as he planned. U.S. Magistrate Judge Jon Scoles on Tuesday appointed federal public defender Jane Kelly to represent Wasendorf. Because of Kelly's recent appointment, Scoles delayed a detention hearing that had been scheduled for Wednesday until next week so she could have time to prepare.

In Waterloo on Wednesday, Wasendorf's former employees met for 90 minutes with local and state officials.

Jack Nees, 28, a server and bartender at myVerona, said Wasendorf dined frequently in the restaurant and was known to send back food if even the slightest thing was off. But he said he was happy Wasendorf had high expectations and was building the best restaurant in town.

"It's going to be a big loss for the community," he said of the closure. "There were a lot of people that really enjoyed it and it's unlikely we'll have something like that again."

Capital One repays consumers to end card probe

(AP) ? Capital One Bank will pay $210 million to settle federal charges that it tricked credit card customers into buying costly add-on services like payment protection and credit monitoring.

Most of the money will go directly to refund customers who were led to believe the services were free or mandatory or offered more benefits than they did, officials said Wednesday.

The order against Capital One is the first enforcement action by the Consumer Financial Protection Bureau, which was set up a year ago to protect consumers from excessive or hidden fees and other financial threats.

Under its agreement with the CFPB, Capital One will pay about $150 million to 2.5 million customers and an additional $25 million penalty. Capital One will pay a $35 million penalty to the Office of the Comptroller of the Currency, a separate federal agency that oversees its banking operations.

The refunds will go to customers who bought add-on card services between August 2010 and January 2012. They will receive the full amount of fees they paid and any other related costs.

CFPB officials said they observed heavy-handed tactics by Capital One call center workers as they monitored the bank's operations. The CFPB can oversee the biggest banks and certain other companies by stationing employees at their headquarters.

The charges hinge on the consumer bureau's allegation that Capital One's call-center vendors were "deceptive" in selling the add-on services. The CFPB can charge companies engaged in "unfair, deceptive or abusive practices."

Banks and consumer groups have been locked in a public battle about how the young agency would use that power. Wednesday's action provided the first clue to its plans. The CFPB held Capital One responsible for the behavior of a third-party vendor, a rare but not unheard-of decision by federal regulators.

The CFPB's action was also notable for requiring automatic refunds to consumers who were duped ? a simple process compared with the mailings and paperwork involved in most class-action settlements.

The action solidifies the role of an agency whose very existence remains a subject of stiff debate on Capitol Hill.

Republicans wanted it to be run by a bipartisan commission instead of an independent director and wanted Congress to have power over the agency's budget. The agency's champions say the agency needed independence to avoid outside influence.

Republicans delayed some of the agency's powers by holding up the appointment of its director, former Ohio Attorney General Richard Cordray. President Barack Obama installed Cordray in January using a recess appointment that Republicans say was not valid.

In a statement Wednesday, Cordray said the agency is "putting companies on notice that these deceptive practices are against the law and will not be tolerated."

Capital One said the third-party vendor had violated its instructions. Still, Capitol One card division president Ryan Schneider apologized to customers in a statement, adding, "We are accountable for actions that vendors take on our behalf."

The consumer bureau, which was created under the Obama administration's financial overhaul law, is the first federal regulator focused on protecting consumers, rather than on ensuring that banks are stable and profitable.

Its officials referred the issue to the agency's enforcement division.

The $25 million penalty will go to the CFPB's civil penalty fund, which is used to refund victims of consumer abuse and pay for financial education programs.

Capital One settled the matter without admitting or denying the allegations described by its regulators. Stock of the parent company, Capital One Financial Corp., fell 51 cents to $55.32.

Disentangling information from photons

ScienceDaily (July 12, 2012) ? Theoretical physicist Filippo Miatto and colleagues from the University of Strathclyde, Glasgow, UK, have found a new method of reliably assessing the information contained in photon pairs used for applications in cryptography and quantum computing. The findings, published in The European Physical Journal D, are so robust that they enable access to the information even when the measurements on photon pairs are imperfect.

The authors focused on photon pairs described as being in a state of quantum entanglement: i.e., made up of many superimposed pairs of states. This means that these photon pairs are intimately linked by common physical characteristics such as a spatial property called orbital angular momentum, which can display a different value for each superimposed state.

Miatto and his colleagues relied on a tool capable of decomposing the photon pairs' superimposed states onto the multiple dimensions of a Hilbert space, which is a virtual space described by mathematical equations. This approach allowed them to understand the level of the photon pairs' entanglement.

The authors showed that the higher the degree of entanglement, the more accessible the information that photon pairs carry. This means that generating entangled photon pairs with a sufficiently high dimension -- that is with a high enough number of decomposed photon states that can be measured -- could help reveal their information with great certainty.

As a result, even an imperfect measurement of photons' physical characteristics does not affect the amount of information that can be gained, as long as the level of entanglement was initially strong. These findings could lead to quantum information applications with greater resilience to errors and a higher information density coding per photon pair. They could also lead to cryptography applications where fewer photons carry more information about complex quantum encryption keys.

Police blotter: Spartanburg woman accused of stealing sports drink, pork rinds from store

Published: Sunday, July 8, 2012 at 3:15 a.m.
Last Modified: Monday, July 9, 2012 at 12:52 a.m.

Spartanburg County Sheriff's Office

A Spartanburg woman has been charged in two incidents, including the theft of a sports drink and pork rinds from a local store, on June 29.

Tonya Michelle Gray, 40, of 107 Kimberly Lane, has been charged with strong-arm robbery, according to an arrest warrant.

The warrant states that on June 29, Gray used force or intimidation to take the drink and pork rinds from a clerk at the Dollar General store on Hayne Street.

In an unrelated incident, Gray has been charged by the Spartanburg Public Safety Department with second-degree assault and battery. According to a warrant, Gray scratched and choked the victim, and pulled out a knife during the assault.

Gray was arrested Friday and remained at the Spartanburg County Detention Facility on Sunday on a $10,000 bond. She also has a $160 bond for a Spartanburg County Magistrate Court bench warrant, according to online jail records.

Melanoma: Molecule in immune system could help treat dangerous skin cancer

ScienceDaily (July 8, 2012) ? Researchers from Brigham and Women's Hospital (BWH) have made a groundbreaking discovery that will shape the future of melanoma therapy. The team, led by Thomas S. Kupper, MD, chair of the BWH Department of Dermatology, and Rahul Purwar, PhD, found that high expression of a cell-signaling molecule, known as interleukin-9, in immune cells inhibits melanoma growth.

Their findings will be published online in the July 8, 2012 issue of Nature Medicine.

After observing mice without genes responsible for development of an immune cell called T helper cell 17 (TH17), researchers found that these mice had significant resistance to melanoma tumor growth, suggesting that blockade of the TH17 cell pathway favored tumor inhibition. The researchers also noticed that the mice expressed high amounts of interleukin-9.

"These were unexpected results, which led us to examine a possible contribution of interleukin-9 to cancer growth suppression." said Purwar.

The researchers next treated melanoma-bearing mice with T helper cell 9 (TH9), an immune cell that produces interleukin-9. They saw that these mice also had a profound resistance to melanoma growth. This is the first reported finding showing an anti-tumor effect of TH9 cells.

Moreover, the researchers were able to detect TH9 cells in both normal human blood and skin, specifically in skin-resident memory T cells and memory T cells in peripheral blood mononuclear cells. In contrast, TH9 cells were either absent or present at very low levels in human melanoma. This new finding paves the way for future studies that will assess the role of interleukin-9 and TH9 cells in human cancer therapy.

"Immunotherapy of cancer is coming of age, and there have been exciting recent results in patients with melanoma treated with drugs that stimulate the immune system," said Kupper. "We hope that our results will also translate to the treatment of melanoma patients, but much work still needs to be done."

According to the researchers, other cell-signaling molecules have been used in treating melanoma; however, this study is the first to investigate the role of interleukin-9 in melanoma tumor immunity.

Melanoma is the most dangerous form of skin cancer. The National Cancer Institute estimates that in 2012, there will be more than 76,000 new cases of melanoma in the United States and 9,180 deaths. Melanoma is curable if recognized and treated early.

Protein May Keep Flu Away

Everybody knows that a good immune system helps to fight the flu. Now a new animal study, published in the journal PLoS One, found that a synthetic protein called EP67 can activate the immune system and help fight the flu if it is administered within 24 hours of exposure to the virus.

Researchers from San Diego State University and the University of Nebraska Medical Center tested the protein in mice by first infecting them with the flu virus and then giving them a dose of the protein within 24 hours.

Mice normally lose about 20 percent of their body weight when exposed to the flu, but the mice treated with the protein lost an average of only 6 percent. Some didn't lose any weight at all.

Even more important, researchers said that mice infected with a lethal dose of influenza did not die after receiving the protein.

"EP67 can protect from a lethal dose of influenza even when treatment is delayed for a full day after the time of infection," said Joy Phillips, lead author of the study. "This protection is not limited to a single strain of influenza, as is the case for the vaccine, but should protect against all strains of influenza A or influenza B."

Phillips said the protein has not been tested against highly pathogenic strains like the avian H5N1 influenza, but it's possible it would also protect against such strains.

"EP67 should be effective against a wide variety of pathogens," said Phillips. "Since EP67 works by stimulating local innate immunity, it should prove effective against viral, bacterial and fungal diseases."

While the protein requires much more pre-clinical research before it can be expected to be used in real-world application, Phillips said, in the future, it may be used as an emergency therapeutic for emergency workers, family members and close contacts of patients.

"As an emergency therapeutic, EP67 has the potential to protect against a myriad of possible pathogens without needing to first identify any specific organism," said Phillips. "This has significant implications in the fields of global health and bioterrorism, and to the field of veterinary medicine as well."

She recently discovered that EP67 appears to function in mammals, and even chickens.

"Work focused on bioterrorism often stresses protection against human pathogens, but protecting the world food supply is another extremely important concern," Phillips continued.

Nevertheless, the present study only involved mice, and only one strain of influenza, so the research will have to be extended to other species and involve challenges with multiple flu strains before predictions can be made about applications, said Philip Alcabes, professor in the department of allied health at Adelphi University, who was not involved in the study.

"Still, since surveillance and control of flu viruses circulating among many non-human species is very important for enhancing the protection of human health globally, information like this could point the way to further research that might be very useful," said Alcabes.
